Court forms commission to record Musharraf’s statement in treason case

ISLAMABAD (92 News) – A special court on Monday ordered formation of a judicial commission after former president Gen (r) Pervez Musharraf declined to record his statement via video link in high treason case. A three member bench headed by Justice Muhammad Yawar heard the high treason case against Pervez Musharraf today. The bench ordered to constitute the judicial commission for recording the statement of Musharraf. The court said if Pervez Musharraf has any objections to the constitution of the commission, he may approach the courts. Hearing of the case has now been adjourned till 14th of next month. During the hearing, the lawyer of Musharraf and prosecution team appeared before the court. The lawyer informed a special bench that his client is indisposed. Justice Yawar Ali said that Pervez Musharraf is out of the country and according to his counsel he is ill. His statement should be recorded under article 342. The justice asked the lawyer that Is it possible to initiate the case trial without recording of 342 statement. Following to this, the counsel submitted the written reply of Musharraf, saying that the former president wants to record his statement after his return. “Musharraf wishes to appear before court himself and present the evidence in his defence. He wants to reveal the truth regarding this case and his statement is very important for this purpose, Musharraf’s counsel said. Justice Yawar Ali said that the medical certificate of the American Hospital of Dubai was issued on August 14 and it is outdated. The counsel said that his client suffering from serious heart ailment. His next medical examination will be conducted in October. The counsel sought more time from the bench if it want a fresh medical certificate of his client. The case was initiated against former military strongman for suspending the Constitution on Nov 3, 2007 by proclamation of emergency, an offence for which charges framed against him on March 31, 2014.
