ISLAMABAD (92 News) The Supreme Court (SC) on Monday adjourned the hearing of a review petition challenging its decision on the defection clause under Article 63-A of the Constitution after Justice Munib Akhtar recused himself from the five-member bench.
Initially, constituted under the chairmanship of Chief Justice of Pakistan (CJP) Qazi Faez Isa, the five-member SC bench consisted of Justice Aminuddin Khan, Justice Jamal Khan Mandokhail, Justice Mazhar Alam, and Justice Munib Akhtar.
However, as soon as the hearing of the case started on Monday, Justice Munib Akhtar recused himself from the bench, after which the CJP adjourned the hearing of the case till Tuesday, saying that the judge will be requested to join the bench again.
CJP Faez Isa said, “We will try to bring Justice Munib Akhtar back to the bench. Otherwise, the bench will be reconstituted.”
It is worth mentioning here that a petition filed in the SC sought a review of its judgment delivered on May 17, 2022, regarding the defection clause under Article 63-A of the Constitution.
