ISLAMABAD (92 News) Justice Naeem Akhtar Afghan replaced Justice Munib Akhtar in the new five-member bench of the Supreme Court constituted on Tuesday to take up the review petition regarding interpretation of Article 63-A of the Constitution.
According to the new cause list, the bench, headed by Chief Justice of Pakistan (CJP) Qazi Faez Isa, consists of Justice Ameenuddin Khan, Justice Jamal Khan Mandokhail, Justice Mazhar Alam Miankhel, and Justice Naeem Akhtar Afghan.
On Monday, the Supreme Court adjourned the hearing of a review petition challenging its decision on the defection clause under Article 63-A of the Constitution after Justice Munib Akhtar recused himself from the five-member bench.
Initially, constituted under the chairmanship of Chief Justice of Pakistan (CJP) Qazi Faez Isa, the five-member SC bench consisted of Justice Aminuddin Khan, Justice Jamal Khan Mandokhail, Justice Mazhar Alam, and Justice Munib Akhtar.
However, as soon as the hearing of the case started on Monday, Justice Munib Akhtar recused himself from the bench, after which the CJP adjourned the hearing of the case until Tuesday, saying that the judge would be requested to join the bench again.
CJP Faez Isa said, “We will try to bring Justice Munib Akhtar back to the bench. Otherwise, the bench will be reconstituted.”
It is worth mentioning here that a petition filed in the SC sought a review of its judgment delivered on May 17, 2022, regarding the defection clause under Article 63-A of the Constitution.
