SC allows NAB to arrest suspects without issuing notice

ISLAMABAD (92 News) – The Supreme Court (SC) on Wednesday allowed the National Accountability Bureau (NAB) to arrest a suspect without issuing summon or notice. A three-member bench led by Justice Azmat Saeed Sheikh issued an order stating that the anti-graft watchdog has right to arrest a suspect if it has irrefutable evidence. “In such a scenario, it is not required to summon the suspect,” the bench said. During the hearing, the court expressed hope that the bureau would not abuse the power granted upon it. The decision comes amid strong criticism of NAB officials by bureaucrats, current and former government officials. The top court amended laws applying to anti-graft watchdog and gave the watchdog permission to arrest a suspect without issuing a notice. It is pertinent to mention here that the high court stopped anti-graft from arresting suspect Syed Jalil Arshad without issuing any notice. The NAB challenged the high court’s verdict in the top court. On the appeal of the NAB chairman, the SC clarified the detailed verdict related to the law of arrest a suspect. The SC bench comprising Justice Faisal Arab and Justice Mazhar Alam headed by Justice Sheikh Saeed issued the verdict on March19. Recently, former army brigadier Asad Munir committed suicide. He left behind a note, lamenting disrespectful treatment meted out by the NAB.
NAB chief initiates probe over Asad Munir’s alleged suicide
National Accountability Bureau (NAB) Chairman Justice (rtd) Javed Iqbal himself initiated probe into the alleged suicide of Capital Development Authority (CDA) former state member Asad Munir, who was under inquiry by the probe body. According to the details, the NAB Rawalpindi transferred the record pertaining to Brigadier (retd) Asad Munir, who allegedly committed suicide earlier this month, to the NAB chairman. It was also reported that the mobile data of Asad Munir also sought from the concerned cellular company. A day earlier,  Justice (r) Javed Iqbal announced to himself investigate into alleged suicide of Asad Munir. It stated that to fulfill the legal formalities, the chairman has summoned all the record related to the deceased to Rawalpindi. A notification has also been issued in this regard stating that the anti-grraft watchdog chairman would himself investigation into the alleged suicide of Asad Munir.

On March 21, Chief Justice of Pakistan (CJP) Justice Asif Saeed Khosa has taken suo motu notice on the letter of former CDA officer Asad Munir before alleged suicide.
