SC orders to arrest those who had attacked Sindh House

ISLAMABAD (92 News) - The Supreme Court on Monday ordered to arrest those who had attacked Sindh House during a protest demonstration a few days ago.

The court also summoned a detailed report of the incident. The advocate general told court that the ATA sections had not been included in the FIR. "Should we conduct a hearing on the FIR. It will take three days if we discussed this issue. The government should adopt a legal course in this regard," Chief Justice Umar Atta Bandial observed.

Hearing the petition of the SCBA and the presidential reference, Justice Mazhar Alam remarked that the prime minister had stated in Kamalia that efforts were being made to win support of judges. Justice Jamal Khan remarked that the prime minister cannot be stopped from making irresponsible statements.

Chief Justice Umar Atta Bandial said that political parties should have knowledge of not discussing the sub judice cases. "How can the Article 63A be linked to lifetime disqualification?" he questioned the attorney general, asking him to satisfy the court that how the system will be in danger due to estrangement of the lawmakers.

The attorney general told court that the Article 63A was aimed at protecting the system.

Justice Ejazul Hassan termed the horse-trading as cancer. He ruled that no action will be taken against any member if a parliamentary party brings a no-confidence motion against its leaders.

He remarked that the Article 95 talks about the joint government. Justice Jamal Khan observed that how the system is in danger if a member benefits another party.

The chief justice observed that a parliamentary party can bring a no-confidence motion against its leader. "If a party itself brings a no-confidence motion, then no action will be taken against any lawmakers," he added.

He observed that one has to pay the price for violating the party policy. "The Article 63A states that the membership will be cancelled. The court verdict is mandatory on the Article 62(1)f. Under the Article 63, the disqualification is for 2-5 years," he ruled.
