SCBA files review petition in Justice Qazi Faez Isa case
July 15, 2020
ISLAMABAD (92 News) – The Supreme Court Bar Association (SCBA) has filed a review petition against the verdict of Justice Qazi Faez Isa case in Supreme Court (SC) on Wednesday. The SCBA petition requests the apex court to remove paragraphs 3 to 11 of June 19 decision. President of Pakistan, Federal government and Supreme Judicial Council have been made respondents in the petition. The petitioner requested from the top court to review the order to send the matter to Federal Board of Revenue (FBR). The petition adopted a stance that the Judicial Council cannot inquire the properties of judges’ families and their children. It also stated that the court’s directive will affect the rights of Justice Faez Isa’s family. On June 19, a 10-member bench of the SC had declared the reference and show-cause notices issued to Justice Faez Isa as null and void. The case was wrapped up after Justice Isa’s spouse provided the money trail pertaining to her foreign properties and the Federal Board of Revenue provided its input on the matter. The petitioner’s lawyer, Munir A Malik, concluded his arguments in court by saying that the federation had ‘gotten on the wrong bus’ in the case. In his arguments, Malik started by saying that he was unable to understand what the government’s case was. He said his client was accused of hiding the properties intentionally, on which Justice Bandial observed that the yesterday’s hearing reinforced the applicant’s stance as his stance was that the documents should first be obtained from Justice Faez’s wife.
