Single person is responsible for destruction whether it is Martial Law or anyone else, rules CJP

ISLAMABAD (92 News) - The Supreme Court of Pakistan on Tuesday adjourned the Practice and Procedure Act case till October 9.

Hearing the case, Chief Justice Qazi Faez Isa remarked that a single person is responsible for the destruction of the country, whether it is Martial Law or anyone else.

"When the martial law is imposed, everyone throws his weapons. The oath is also forgotten if the martial law is imposed. If the parliament does something, everyone remembers his oath. Everyone is just attacking the parliament. We should examine whether the law is good for the people or not. It is necessary to admit the mistake for correction.

"The Supreme Court can declared some judgment correct and say it wrong the other day. Then you will say that the Supreme Court did something wrong, or you will say that the Supreme Court is the king of the jungle as it does whatever it wants. In this way, the country will not run by the constitution, but through the judgments of the judges," he observed.

Justice Jamal Mandokhel remarked that the Supreme Court rules formulates rules under the constitution and the law, but both the constitution and the law are made by the parliament.

Justice Ayesha Malik observed that the law does not mean only an act of the parliament. Justice Muhammad Ali Mazhar remarked that the Supreme Court itself was created by the constitution.

Justice Ejazul Ahsan remarked that the court should be independent for access to justice. "Firstly, tell us how the right of access to justice is affected by the Act. We have gone far ahead of the admissibility of the applications," he observed.

Justice Mansoor Ali Shah remarked that right to appeal is also given in the Competition Commission Act.
