SC orders to stop all cases of Article 184(3) until formation of rules

ISLAMABAD (92 News) - The Supreme Court on Wednesday ordered to stop the proceedings of all cases of Article 184(3).

It was ruled by a three-member bench headed by Justice Faez Isa.

The court ruled that the chief justice has no power to form a bench. "The chief justice has no power to exclude a judge after the formation of a bench. The chief justice cannot declare his personal wisdom as the sagacity of constitution," it ruled.

The court ruled that the constitution has not empowered the chief justice of using his own will. "The parliamentarians are answerable to the people and the judiciary is answerable to none. The criticism of the judges by the Pakistan Electronic Media Regularity Authority (PEMRA) is against the constitution and Islam," the bench observed.

The verdict by announced by 2-1. Justice Shahid Waheed wrote the dissenting note.
